Ministry of Labour Issues Structured Employer Compliance Checklist Under the Four Labour Codes

The Ministry of Labour and Employment has circulated a structured employer compliance checklist designed to facilitate implementation of the four consolidated labour codes namely, the Code on Wages, 2019; the Industrial Relations Code, 2020; the Code on Social Security, 2020; and the Occupational Safety, Health and Working Conditions Code, 2020.

Gujarat Amends Shops and Establishments Law to Expand Working Hours and Permit Night Shifts for Women

The Government of Gujarat has enacted amendments to the Gujarat Shops and Establishments (Regulation of Employment and Conditions of Service) framework, expanding permissible daily working hours and revising overtime limits for commercial establishments. The amendment also authorises the employment of women during prescribed night hours, subject to explicit consent and mandatory safety safeguards.

Supreme Court of India Upholds Exclusive Jurisdiction Clauses in Private Employment Contracts

In the case of Rakesh Kumar Verma v. HDFC Bank Ltd., decided on April 8, 2025, the Supreme Court of India affirmed the enforceability of exclusive jurisdiction clauses contained in private employment agreements. The matter arose following the termination of two employees of HDFC Bank Ltd., namely Rakesh Kumar Verma and Deepti Sharma, whose employment contracts stipulated exclusive jurisdiction of courts in Mumbai.

Liability of Supervisory Personnel for Non-Remittance of ESI Contributions Irrespective of Designation: Supreme Court of India

The Supreme Court of India, in its judgment dated April 17, 2025, in Ajay Raj Shetty v. Director, has clarified that individuals occupying supervisory roles may be held liable for the non-remittance of Employees' State Insurance (“ESI”) contributions, regardless of their official designation. The Court emphasized that, pursuant to Section 2(17) of the Employees' State Insurance Act, 1948 (“ESI Act”), any person exercising supervision and control over an establishment qualifies as a ‘principal employer’ for the purposes of the Act, even if such responsibility is not explicitly reflected in their formal designation.
