This development, notified under Section 30(3) of the Punjab Shops and Commercial Establishments Act, 1958, is applicable to certain sectors, including:

  1. IT and ITES industries

  1. Banking establishments

  1. Three-star and above hotels

  1. 100% export-oriented units

This latest directive supersedes all previous notifications on the subject and introduces several compliance requirements aimed at safeguarding the rights and welfare of women working during night hours.

Key Compliance Obligations

Employers must obtain written consent from each woman employee agreeing to work night shifts and submit a declaration to that effect.

2. Mandatory Exemption Application

Businesses intending to employ women during night shifts must apply for an exemption from the Labour Commissioner or the Chief Inspector of Shops, Haryana. This application must be filed at least one month prior to the start date of such employment.

The exemption, once granted, will be valid for one year unless there are changes in security protocols, transportation arrangements, or management details.

3. Safe and Secure Transportation

Employers are required to provide to-and-fro transportation for all women employees working night shifts.

Each vehicle must be equipped with:

  1. Security guards, including at least one female guard

  1. Responsible and trained drivers

  1. Effective communication channels for real-time tracking and emergencies

Legal and Policy Significance

This notification reflects a significant move towards enabling equitable workforce participation while reinforcing the importance of workplace safety, especially for women in non-traditional hours. It sets a structured legal framework that allows businesses to operationalize night shifts in a compliant and gender-sensitive manner.

Businesses operating in Haryana in the specified sectors must take immediate steps to align their HR and compliance protocols with this revised framework.
