Ministry of Labour Issues Structured Employer Compliance Checklist Under the Four Labour Codes

The Ministry of Labour and Employment has circulated a structured employer compliance checklist designed to facilitate implementation of the four consolidated labour codes namely, the Code on Wages, 2019; the Industrial Relations Code, 2020; the Code on Social Security, 2020; and the Occupational Safety, Health and Working Conditions Code, 2020.


The checklist is intended to standardise employer obligations and reduce interpretative inconsistencies during inspections and audits.

The compliance matrix sets out actionable requirements relating to timely payment of wages, maintenance of statutory registers (including digital registers where applicable), retrenchment and layoff procedures, standing orders compliance, contractor engagement norms, social security enrolment, and workplace safety measures. Particular emphasis has been placed on documentation standards and managerial accountability, signalling a movement toward evidence-based enforcement.


The issuance of the checklist assumes significance in light of staggered rule notifications by various States. In the absence of uniform state-level operationalisation, the central checklist may function as a harmonising instrument guiding compliance architecture across jurisdictions. Employers are advised to revisit employment contracts, payroll structuring, bonus calculations, and vendor arrangements to ensure alignment with the harmonised wage definition and other structural reforms introduced by the Codes.


Legal Analysis:


The development reflects a transition from fragmented labour compliance to structured supervisory oversight. While the Codes consolidate statutory obligations, enforcement clarity will ultimately shape litigation exposure. Employers would be well-advised to undertake internal compliance audits and board-level reviews, particularly in areas involving wage structuring and retrenchment thresholds, where statutory penalties may be significant.
