Issuance of Draft Second Edition of the Manual for Procurement of Works
The Department of Expenditure, vide Office Memorandum No. F.1/4(3)/2023-PPD dated April 7, 2025, has released the Draft Second Edition of the Manual for Procurement of Works for public consultation. The revised draft introduces key amendments aimed at enhancing procurement processes in line with evolving policy objectives, operational efficiency, and sustainability considerations.
Key highlights of the proposed amendments include:
Refined Definition of ‘Works’: The term ‘Works’ has been redefined to explicitly encompass the entire project lifecycle, including design, construction, operation, and maintenance—providing greater clarity compared to the earlier broad definition.
Enhanced Project Preparation Requirements: The scope of preparatory activities has been broadened to include sustainability assessments, environmental impact evaluations, and stakeholder consultations, in addition to traditional technical and financial feasibility studies.
Revised Security and Payment Provisions: The provisions relating to payment and performance securities have been clarified to specify the acceptable forms of security and provide detailed guidance on payment structures and terms.
Updated Contract Execution Framework: Comprehensive revisions have been proposed for contract execution practices, covering areas such as mobilization advances, monitoring obligations, events of default, termination clauses, and dispute resolution mechanisms. Notably, the draft introduces structured mediation as a formal dispute resolution tool.
The Department has invited feedback from stakeholders on the Draft Second Edition to ensure alignment with contemporary procurement standards and practical implementation needs.
